(“KITCI,” “we,” “us,” or “our”) recognizes the fundamental right to privacy enshrined in the Philippine Constitution and the obligations imposed under Republic Act No. 10173, otherwise known as the Data Privacy Act of 2012 (“DPA”), its Implementing Rules and Regulations (IRR), and relevant issuances of the National Privacy Commission (NPC). As such, we are committed to safeguarding the confidentiality, integrity, and availability of all personal data collected from data subjects who access or use this website.

KITCI may collect personal data, as defined under Section 3(g) of the DPA, either directly from you or through automated means when you voluntarily

2. To facilitate customer relationship management and account administration;
3. To process and evaluate job applications;
4. To improve the functionality, content, and user experience of the website;
5. To send updates, announcements, or marketing communications, subject to your prior consent;
6. To comply with legal and regulatory obligations under Philippine law or orders from competent authorities.

4. Data Sharing and Disclosure

KITCHI shall not disclose, sell, lease, or rent your personal data to third parties for commercial purposes without your express consent, except in the following instances:

• When the disclosure is necessary for the performance of a contract to which the data subject is a party, or in order to take steps at the request of the data subject prior to entering into a contract;
• When the disclosure is required or authorized by law, including lawful orders of courts or government regulatory bodies;
• When the information is shared with third-party service providers, partners, or     contractors engaged by KITCI, who are contractually obligated to ensure the confidentiality and security of such data;
• When the data is necessary to protect the rights, property, or safety of KITCI, its affiliates, employees, or other stakeholders.

All data sharing or processing shall be subject to the execution of a Data SharingAgreement or Outsourcing Agreement, in compliance with NPC Circular No.2020-03.

5. Security Measures

KITCI adopts physical, organizational, and technical measures to protect personal data against accidental or unlawful destruction, alteration, disclosure,misuse, and other unlawful forms of processing. These include, but are not limited to, encryption, firewalls, access control systems, and regular system audits, in accordance with the standards prescribed by the NPC and best practices in cybersecurity.

Pursuant to Section 20 of the DPA, KITCI shall ensure that only authorized personnel with a legitimate purpose shall be allowed to access personal data.

6. Retention andDisposal

Personal data collected shall be retained only for as long as necessary for the fulfillment of the declared and legitimate purposes, or for the establishment, exercise, or defense of legal claims, or as provided by applicable laws and regulations.

Upon expiration of the applicable retention period, personal data shall be securely disposed of or anonymized in accordance with NPC Advisory No. 2022-01 and best practices on data destruction.

7. Rights of the DataSubject

Pursuant to Chapter IV of the DPA, you, as a data subject, have the following rights:

1. Right to beInformed – to be notified and furnished with information before the entry of your personal data into the processing system;
2. Right to Access – to access and obtain a copy of your personal data that is being processed;
3. Right to Object – to object to the processing of your personal data;
4. Right to Erasure or Blocking – to suspend, withdraw, or order the blocking or removal of your personal data from KITCI’s system, under certain conditions;
5. Right to Rectification – to dispute the inaccuracy or error in personal data and have it corrected accordingly;
6. Right to Data Portability – to obtain a copy of your data in a structured, commonly used, and machine-readable format;
7. Right to Damages – to be indemnified for any damages sustained due to inaccurate, incomplete, outdated, false, unlawfully obtained, or unauthorized use of personal data.
